Mississippi is Poised to Become the Next State to Enact Employment Eligibility Verification Legislation


Mississippi is set to become the next state, after Arizona, to enact legislation requiring employers to verify the legal status of their new hires using the federal government's E-Verify program. GIS, a Designated Agent for E-Verify since 2003, can assist you in this process. As you know, employers nationally are facing increasing pressures to verify their employees' legal ability to work in the U.S. The latest legislation in Mississippi is called the Mississippi Employment Protection Act (S.B. 2988) and the mission of this bill is for employers to only hire employees who are legal citizens or legal aliens of the U.S.

The Mississippi Employment Protection Act was unanimously approved by the Senate in February and the House approved the bill on March 5, 2008. The bill now heads to Governor Haley Barbour's desk for his signature. Governor Barbour will likely sign the bill.

The bill applies to private employers, contractors, subcontractors, third-party employers (i.e., leasing companies and contract employers) that conduct business in Mississippi; Mississippi agencies and political subdivisions.

If signed into law, the effective dates begin as early as July 1, 2008 for some employers.
